Welcome to GetCallScout (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of www.getcallscout.com, our software platform, mobile applications, dialer tools, AI features, and all related services (“Services”).

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

3. Use of the Services

You agree to use the Services only for lawful purposes. You may not :

  • Use the platform to send spam, unlawful messages, or unsolicited communications
  • Violate TCPA, 10DLC, carrier rules, or call‑recording consent laws
  • Upload harmful code, attempt to breach security, or interfere with system integrity
  • Reverse engineer, copy, or misuse any part of the platform
  • Use the Services to harass, defraud, or harm others

We reserve the right to monitor usage for compliance and to protect the platform.

4. Call Recording & Consent Responsibilities

GetCallScout provides tools that may enable call recording, transcription, and AI‑generated summaries.
You are solely responsible for complying with all call‑recording and consent laws in your jurisdiction.

This includes :

  • Notifying call participants when required
  • Obtaining consent where applicable
  • Maintaining proper documentation

We do not provide legal advice regarding compliance.

5. Messaging, 10DLC, and TCPA Compliance

If you use SMS, voice, or automated calling features, you agree to :

  • Obtain proper opt‑in consent
  • Maintain opt‑out mechanisms (“STOP,” “UNSUBSCRIBE”)
  • Follow carrier rules and 10DLC registration requirements
  • Comply with the Telephone Consumer Protection Act (TCPA)

Violations may result in account suspension or carrier penalties.

6. Integrations & Third‑Party Services

Our platform may integrate with third‑party tools (e.g., CRMs, email providers, payment processors).

By enabling integrations, you authorize us to access and process data from those services.

We are not responsible for :

  • Third‑party service outages
  • Data loss caused by third‑party systems
  • Changes to third‑party APIs or policies

7. Subscription, Billing & Payments

7.1 Subscription Terms
Access to the Services may require a paid subscription. Plans renew automatically unless canceled.
7.2 Payment Processing

Payments are handled by third‑party processors.
You authorize recurring charges to your payment method.

7.3 Refunds
Unless required by law, all fees are non‑refundable.
7.4 Price Changes

We may modify pricing with notice. Continued use after notice constitutes acceptance.

8. Intellectual Property

All content, software, trademarks, branding, and materials provided by GetCallScout are owned by the Company or its licensors.

You may not :

  • Create derivative works based on the platform

9. User Content

You retain ownership of the content you upload, including :

  • Contact lists
  • Scripts
  • Notes
  • Call recordings
  • CRM data
By using the Services, you grant us a license to process, store, and use your content solely to operate and improve the platform.

You represent that you have the legal right to upload and process all data you provide.

10. Prohibited Activities

You may not use the Services to :

  • Send fraudulent, deceptive, or harmful communications
  • Engage in phishing, spoofing, or identity misrepresentation
  • Upload viruses or malicious code
  • Attempt unauthorized access to systems or data
  • Conduct competitive analysis or scrape data

11. Termination

We may suspend or terminate your account if :

  • You violate these Terms
  • You misuse the platform
  • Required payments fail
  • Your activity poses risk to the platform or other users

Upon termination :

  • Your access to the Services ends
  • We may retain data as required by law or for legitimate business purposes

12. Disclaimers

The Services are provided “as is” and “as available.”

We do not guarantee :

  • Uninterrupted or error‑free operation
  • Accuracy of AI‑generated summaries or analytics
  • Compatibility with all devices or networks

You use the Services at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law :

  • GetCallScout is not liable for indirect, incidental, special, or consequential damages
  • Our total liability for any claim is limited to the amount paid in the previous 12 months

Some jurisdictions do not allow certain limitations, so these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless GetCallScout from claims arising out of :

  • Your use of the Services
  • Violations of laws (including TCPA, 10DLC, GDPR, CCPA)
  • Uploaded content
  • Misuse of communication tools
